These Terms of Service ("Terms") govern your access to and use of BoomerBing.com, shop.BoomerBing.com, and other BoomerBing™ websites, online stores, pages, communities, content, products, services, and digital experiences that link to these Terms.
BoomerBing™ is operated by Podcast Excellence Academy LLC, doing business as BoomerBing™.
References in these Terms to "BoomerBing," "we," "us," or "our" refer to Podcast Excellence Academy LLC and the BoomerBing™ brand.
References to "you" or "your" refer to the person accessing our websites, purchasing products, participating in our communities, or using our services.

Shopping And Purchases
4. Product Orders
Products displayed through the BoomerBing™ store are offered subject to availability and acceptance of your order.
Submitting an order does not guarantee that the order can be fulfilled.
We reserve the right, where reasonably necessary, to reject or cancel an order because of:

If we cancel an order after payment has been collected and no product will be provided, we will issue an appropriate refund.
5. Made-to-Order Merchandise
Many BoomerBing™ products are produced specifically after an order is placed.
This may include apparel, hats, accessories, drinkware, and other merchandise.
Because these products are made to order:
• Production may begin soon after an order is submitted • Cancellations may not be possible after production begins • Product changes may not be possible after production begins • Traditional exchanges may not be available • Buyer-remorse returns generally are not accepted
Please carefully review your product, size, color, quantity, shipping address, and other order information before completing your purchase.

6. Product Descriptions and Images
We make reasonable efforts to display product descriptions, photographs, mockups, colors, sizing information, features, and other product information accurately.
However, certain variations may occur.
For example:
• Colors may appear differently depending on your screen or device • Printed colors may vary slightly from digital images • Placement of printed or embroidered designs may vary slightly between items • Product dimensions may have normal manufacturing tolerances • Garment fit may vary by manufacturer, style, and material • Packaging may change • Manufacturers may make minor product modifications
Product images may include mockups or digital representations.
Reasonable manufacturing or display variations do not necessarily constitute defects.
Nothing in this section limits your rights if an item is materially different from what you ordered, damaged, defective, misprinted, or otherwise qualifies for a remedy under our Returns & Refunds Policy or applicable law.
7. Sizing
Customers are responsible for reviewing available sizing information before ordering apparel or wearable products.
Sizing may vary between:

A product that matches the size selected on your confirmed order generally does not qualify for a refund or exchange solely because the customer would prefer another size.
If the size delivered is different from the size shown on your confirmed order, please contact us in accordance with our Returns & Refunds Policy.
8. Pricing
Prices are displayed in the currency indicated on the website at the time of purchase.
We may change product prices at any time before an order is completed.
Price changes do not ordinarily affect previously completed purchases.
We make reasonable efforts to ensure pricing is accurate. However, typographical, technical, system, or other pricing errors may occasionally occur.
If an obvious pricing error affects an order, we may contact you to resolve the issue or cancel the affected order.
If we cancel a paid order because of a pricing error, we will refund the amount collected for the canceled order.

• Gift cards may be used only for eligible BoomerBing™ purchases • Gift cards are not redeemable for cash except where required by law • Gift cards may not be resold or used for unauthorized commercial purposes • Lost or stolen gift cards may not be replaceable unless required by law • Fraudulent or unauthorized gift-card activity may result in cancellation
Any expiration dates, fees, redemption conditions, or other gift-card restrictions will comply with applicable law.
Product-specific gift-card terms presented at the time of purchase will also apply.
Fulfillment And Shipping
13. Third-Party Fulfillment
BoomerBing™ may use third-party manufacturers, print-on-demand providers, fulfillment partners, warehouses, and shipping carriers to produce and deliver products.
By purchasing a product, you acknowledge that certain order information may be provided to these providers as reasonably necessary to:
• Manufacture merchandise • Print or embroider products • Package orders • Ship orders • Provide tracking information • Resolve fulfillment or delivery issues

14. Processing and Shipping Times
Processing, production, and shipping estimates are provided for convenience and are not guaranteed delivery dates unless expressly stated otherwise.
Delivery timing may be affected by circumstances including:

15. Multiple Shipments

Receiving part of an order does not necessarily mean another item is missing.

16. Shipping Addresses

BoomerBing™ is not responsible for delays or delivery problems caused by incorrect or incomplete address information supplied by the customer, except to the extent otherwise required by law.

17. Lost, Damaged, or Incorrect Orders
Claims involving:

are governed by our Returns & Refunds Policy.
Customers should submit claims promptly and within the applicable claim periods stated in that Policy.
Returns And Refunds
18. Returns, Replacements, and Refunds
Purchases are subject to the BoomerBing™ Returns & Refunds Policy in effect at the time of purchase.
Because many products are made to order, we generally do not accept returns or exchanges due solely to:
• Buyer's remorse • Change of mind • Incorrect size selected by the customer • Incorrect color selected by the customer • Preference for another product
Damaged, defective, misprinted, incorrect, missing, or lost products may qualify for a replacement, refund, or other resolution as described in the Returns & Refunds Policy.
Nothing in these Terms limits non-waivable consumer rights provided by applicable law.
Website And Community Use
19. Accounts and Account Security
Certain BoomerBing™ features may allow or require you to create an account.
If you create an account, you are responsible for:

If you voluntarily submit content to BoomerBing™, including reviews, photographs, comments, testimonials, suggestions, or other materials, you retain whatever ownership rights you legally have in that content.
You grant BoomerBing™ a non-exclusive, worldwide, royalty-free license to use, reproduce, display, format, and distribute that submitted content for reasonable business purposes associated with BoomerBing™, including operating our websites, displaying customer reviews, marketing our products, and promoting our services, subject to applicable law and any separate agreement with you.
You represent that you have the right to submit the content and grant this permission.
This license does not give BoomerBing™ ownership of your underlying intellectual property.
If a separate written agreement governs a testimonial, creative work, photograph, video, or other content, that agreement will control.

23. BoomerBing™ Intellectual Property
Unless otherwise stated, the content available through BoomerBing™ websites and services is owned by or licensed to Podcast Excellence Academy LLC.

Nothing in these Terms transfers ownership of BoomerBing™ intellectual property to you.

36. Venue
To the extent permitted by applicable law, disputes arising from these Terms or your use of BoomerBing™ that require judicial resolution will be brought in an appropriate state or federal court located in Clark County, Nevada.
This section does not override any consumer right to bring a matter in another forum where applicable law does not permit that right to be waived.
37. Electronic Transactions
You agree that transactions with BoomerBing™ may be conducted electronically.
Electronic communications, order confirmations, notices, agreements, and records may satisfy legal requirements that communications or records be in writing, to the extent permitted by applicable law.
You are responsible for maintaining a valid email address when electronic communication is necessary to complete your transaction.
38. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, when legally permissible.
The remaining provisions will continue in effect unless the invalid provision is essential to the agreement and applicable law requires otherwise.

If BoomerBing™ does not immediately enforce a provision of these Terms, that does not necessarily mean we have permanently waived the right to enforce that provision.

40. Assignment
You may not transfer your contractual rights or obligations relating to a purchase to another person when doing so would materially affect BoomerBing™'s rights or obligations, except as permitted by law.
BoomerBing™ may transfer these Terms as part of a legitimate merger, acquisition, restructuring, sale of business assets, or similar transaction, subject to applicable law.
41. Entire Agreement
These Terms, together with the Privacy Policy, Returns & Refunds Policy, and any applicable product-specific or service-specific terms, constitute the agreement governing your use of the applicable BoomerBing™ website, product, or service.
If a separately signed written agreement between you and Podcast Excellence Academy LLC specifically governs a service or transaction, that agreement will control to the extent of any conflict.
